Organizing licensing

As much as this is for charity, we can't just stick our own copy of Serenity, Dr Horrible or other shows into a DVD projector and charge people admission.

If you're showing any copyright film or playing any copyright music in a public environment, you need to have either a Public Performance License for a theatrical (cinema) or non-theatrical venue.

Universal own the rights to Serenity and fairly claim compensation for the viewing of it.

Quote:
What is Non-theatrical?

Non-theatrical Market refers to all publicly performed exhibition of feature films, in any and all linear formats and via any and all delivery systems, now known (including, without limitation, direct-to-optical projection, videogram display, closed circuit transmission and satellite transmission) or hereafter devised, that are shown in all educational institutions; correctional facilities; libraries; museums; government institutions; community centres; recreational facilities; hospitals and other health care facilities; shut-in institutions; common areas of apartments, condominiums, dormitories and other residential communities; retirement centres; camps; religious institutions; all manner of fraternal, benevolent and community clubs and organizations; bars; restaurants; hotels; conference facilities; business facilities; and buses and other transportation services.

If any CSTS organising team screens copyright materials without the necessary licenses (this includes playing soundtrack CDs), you are putting CSTS at risk for everyone, and are also personally risking a hefty fine or other penalties from the license holder. So, for the sake of all of us, please obey the rules around sceening licensing.

Once you have completed Registration, you will be provided with information about who to contact to arrange licensing.

Things to take note of:

• Allow plenty of time to get your licensing. Depending on the company you deal with, this can take up to 3 months to organise.
• If you are granted DVD licensing you will need to supply your own copy of Serenity. Be aware that only the movie is licensed for showing, the extras are not, and cannot be licensed for showing.
• Whilst previous CSTS events may have also shown Firefly, Buffy, or Angel episodes, this is no longer allowed as Fox has forbidden all non-theatrical (and theatrical) use of their episodes, which includes all our favorite Whedon TV shows. So unfortunately, no combining with a “Once More with Feeling” musical extravaganza.
• Rights for other screening media, like Dr Horrible's Sing-along Blog, have a very different process. The Global Team each year will attempt to secure the rights for everyone, but this is not guaranteed to be available.

For more details on Serenity licensing, go to viewtopic.php?f=4&t=1193 (Organiser Level Access Required)

Please note that all discussions about Dr. Horrible below are OLD and no longer apply.

Regarding Dr Horrible licencing, the following has just been posted at www.drhorrible.com:

Quote:
Production Inquiries

Sorry to say: At this time, no license requests are being reviewed or granted with respect to performances of Dr. Horrible. We obviously will not, could not, and would not stop you from performing Dr. Horrible with your friends for the hell of it. Just for kicks, as they say. But for now, we have plans of our own and are not licensing it.

Additionally, no rights to Commentary! The Musical are available to license.

If and when this decision is reversed and we once again will license the rights to perform Dr. Horrible, we will post that information here for you. In the meantime, thank you for caring enough to even find your way to this page to read this. You are awesome. For realzies.

- J, J, M & Z

This means that, under no circumstances can any CSTS event include a live performance of Dr Horrible, or a screening with "Commentary! The Musical", or any a live or recorded performance of "Commentary! The Musical". Sorry folks! :(

For 2011, Most certainly, yes.

Quote:
I'm happy to announce that we have permission to show Dr. Horrible at our Affiliate and Screening Events this year. I repeat, we have been granted permission to show the three episodes of Dr. Horrible at Affiliate and Screening Events. However, we cannot show any other materials from the DVDs. NO live performances or viewing of 'Commentary the Musical' under any circumstances. Please adhere to the limited scope of this license. Permission was granted to us very graciously, and we want to keep a good working relationship for years to come.

Wait, so what is the process of getting permission to screen Dr. Horrible, if we wanted to do that for start up money for our CSTS event? Do we need to get permission or can we screen it and just not charge admission? Can we screen it for free admission but ask for donations for start up money for our CSTS event?

From how I understand it, we have been given permission to show Dr. Horrible as part of the CSTS event. That means you cannot show it publicly in advance. So yes, I'm afraid this can't be used to raise start-up money. William can correct me if I am wrong.

You are correct. We have permission to show Dr. Horrible at our Affiliate and Screening events only, so actually you can run an Affiliate event in support of a larger screening event in the same area.

As long as your 'registered' affiliate is part of a process leading up to one large donation, you can use it to help raise money, but please advertise it as part of the greater whole.

There would be no reason why you couldn't organise an Affiliate Event featuring Dr Horrible ahead of your main CSTS event if you wanted to. As long as your pre-event is registered, you would be able to screen Dr Horrible.

For example, in Melbourne, we run a whole season of events. Each month, between June and September, we hold an event of some kind. For our pre-events, we try to find venues that are free or very cheap, and screen something like Done the Impossible, Dr Horrible or Browncoats: Redemption, with a few prizes to encourage attendance. The profits from each event are then pooled into our CSTS fund for that year (since they're generally free to run with no venue cost, no licencing cost and donated prizes, all entry ticket and raffle sales are profit). The main event has venue, licensing and merchandising costs, which is then paid for out of our CSTS fund. All of the profits from the main event go into the CSTS fund, and we then run a few post-events to finish off the season and add more money to the fund. Once we're all finished, we finalise our books and all money in the CSTS fund is donated to Equality Now.

You would have to make sure that each event runs at a profit, and that attendees know that the donation will be made based on the success of all events you're running (ie. multiple events but one donation).

For seed money though, it's generally a good idea to find someone who's willing to cover one or more of your significant costs (which they can donate or be reimbursed for). Events should not be run purely to raise seed money for later events - all events should be organised as charity fundraisers.

Thank you for all the EXCELLENT info!! We have enough people willing to front the cost of the CSTS main event, but who expect reimbursement after the event takes place.

A timely reminder about why we can't screen any of the Whedon television shows:

Fox hits local ‘Firefly’ group with cease and desist

So, please do not include any screenings of Buffy, Angel, Firefly or Dollhouse in your CSTS events. :)

Agreement with Swank indicates they are the ones providing us with the only copy we're allowed to use.

So please clarify: our Lincoln, R.I. CSTS event has permission to to do a shadowcast of Dr. Horrible on July 23, 2011, like we did last year? That would be awesome!

Ok, so I need to clarify: can we show Dr. Horrible before screening Serenity at our CSTS event, AND can we do it as a shadowcast, with players acting out the scenes in front of the screen at the same time? I know we CAN'T do the Commentary portion of Dr. Horrible.

Our alternative is to screen Browncoats: Redemption before Serenity.

NO Shadowcasting. All you can do is show it. As it says above
Quote:
NO live performances
and that would count as a live performance.

So yes you can show it before Serenity but NO it cannot be acted out.
